Appeal Filed in Suit Against KFC Supplier

Morganton, N.C. – Today, Legal Impact for Chickens filed a notice of appeal to the North Carolina Court of Appeals challenging the dismissal of its lawsuit against Case Farms, one of the country’s largest poultry producers. The lawsuit, filed in May 2023, alleges that Case Farms violates North Carolina’s cruelty laws by causing chicks unjustifiable pain and suffering at its Morganton, N.C. hatchery. LIC accuses Case Farms of a pattern of gross mismanagement and cruelty in violation of North Carolina law.

“Case Farms subjects chickens to gratuitous and illegal cruelty,” says Legal Impact for Chickens President Alene Anello. “Case Farms has shown more willingness to pay lawyers to shield the company from accountability, than willingness to simply reduce animals’ pain and suffering by paying an adequate number of employees to do the work without crushing chicks. We’re asking the Court of Appeals to give these animals a chance under the law.”

Case Farms has been documented knowingly operating faulty equipment, including a machine piston which repeatedly smashes chicks to death and a dangerous metal conveyor belt which traps and kills young birds. Case Farms was also documented crushing chicks’ necks between heavy plastic trays. LIC believes that the North Carolina Court of Appeals will agree that Case Farms is not immune from the cruelty law and cannot escape liability for its behavior.
